DEED RECORD.
M. S. CHAPEL & wife to Calvin DODGE
WARRANTY DEED.

This Indenture, Made this 30th day of November in the year of our Lord one thousand eight hundred and Eighty one, between M. S. CHAPEL and Esther E. CHAPEL his wife of Asherville in the County of Mitchell and State of Kansas of the first part, and Calvin DODGE of New Lyme in the County of Ashtabula and State of Ohio of the second part,

WITNESSETH, That the said parties of the first part, in consideration of the sum of Twelve Hundred DOLLARS, to them duly paid, have sold and by these presents do grant and convey to the said party of the second part, his heirs and assigns, all that tract or parcel of land situated in the County of Mitchell and State of Kansas, and described as follows, to-wit:

West half of SW 1/4 of Sec Thirty four (34) Township Seven (7) south of Range Six (6) west and the East 1/2 of SE 1/4 of Sec thirty three (33) Except a tract described as follows to wit commencing at the N W corner of East 1/2 of SE 1/4 of Sec thirty three (33) and running East Sixty four (64) rods thence south thirty four (34) rods thence West four (4) rods thence south twenty six (26) rods thence West sixty (60) rods thence North Sixty (60) rods to place of beginning all in township Seven (7) south of Range Six (6) west with the appurtenances, and all the estate, title and interest of the said parties of the first part therein. And the said parties of the first part do hereby covenant and agree that at the that at the deliver hereof they are the lawful owners of the premises above granted and seized of a good and indefeasible estate of inheritance therein, free and clear of all incumbrances, and that they will WARRANT AND DEFEND the same in the quiet and peaceable possession of said party of the second part, his heirs and assigns FOREVER, against all persons lawfully claiming the same.

IN WITNESS WHEREOF, the said parties of the first part have set their hands and seals the day and year above written

BE IT REMEMBERED, That on this 30 day of November A.D. 1881, before me, a Notary Public in and for said county, came M. S. CHAPEL and Esther E. CHAPEL his wife known to be the same person who executed the foregoing instrument and duly acknowledged the execution of the same.

IN TESTIMONY WHEREOF, I have hereunto subscribed my name and affixed my official seal on the day and year last above written.

Except one certain mortgage for Eight Hundred (800) Dollars Executed to D. S. CHAPEL by M. S. CHAPEL and Esther E. CHAPEL his wife Dated on or about Jan 17 1873 and duly recorded in the office of the Register of Deeds of Mitchell County Kansas in Book A on Page 89 of Mortgage records.
