The last Will and Testament of John Dodge of Frankfort County of Herkimer and State of New York I John Dodge considering the uncertainty of this mortal life and being of sound mind and memory Blessed be Almighty God for the same do make and publish this my last will and testament in manner and form following that is to say First ? I give and bequeath unto my beloved wife Sally Dodge the use & improvement of all my Real Estate where I now live and the use of all my personal property & effects wherever found to have & to hold the use and improvement of the same during the time she may remain my widow for her own support and the support & maintenance and education of my minor children viz my son Hiram Dodge, James M. Dodge, Washington Dodge, Ira Dodge and Ezra Dodge and my daughters Loisa Dodge & Harriet Dodge and should my wife Sally Dodge marry again after my decease it is my will expressly that she shall have the use & improvement of only one third part of my Real Estate and one third of my personal property during her natural life and the remaining two thirds shall be used and applied for the maintenance and support of my above named infant children. And should the County lands that I claim for Revolutionary services being situate in the State of Ohio ever be obtained by my Executors I will & bequeath the same to my sons John Dodge, Daniel Dodge and Hiram Dodge for their sole use & benefit and it is further my will that after the decease of my wife Sally Dodge all my property viz Real Estate & personal property be equally divided between my said children then living should they be all of full age otherwise to remain undivided until they all become of age. And I do further will that my said Executors shall pay or cause to be paid all my just & honest debts from the moneys that may be collected which is [sic] now due me and should that be deficient to take such other moneys as I may have at my disposal at my decease, and it is my will that the remaining part of pension money which I may have on hand at my decease or my said Executors may draw after my decease shall be expended in repairing my house to make it comfortable and the residue to fence and repair the fences on my farm where I now live & I do hereby appoint my beloved wife Sarah Dodge and my son Daniel Dodge my Executors of this my last will and Testament and further there shall be no misunderstanding of my intentions it is expressly my intention that my wife Sally Dodge shall have the use and improvement of all my Real Estate and personal property of every description where ever found excepting my County land in the State of Ohio which I have otherwise disposed of so long as my wife Sally may remain my widow for her support and for her to bring up my infant children but if my wife Sally should marry again after my decease she to have the use and improvement of only one third part of my personal property during her natural life and after her decease to go to my children hereby revoking all former wills by me made. In witness whereof I have hereunto set my hand and seal the fifteenth day of November in the year of our Lord one thousand eight hundred and twenty eight. Signed sealed published & declared by the above named John Dodge to be his last will & Testament in the presence of us who have hereunto subscribed our names as witnesses in the presence of the testator and in the presence of each other. John Dodge Thomas Wadsworth Senior Zedekiah Haven Thomas Wadsworth Jr. The People of the State of New York by the Grace of God Free and Independent: To all to whom these presents shall come or my concern I send Greeting: Know ye that at a Surrogates Court for the County of Herkimer before Arphaxed Loomis Esq Surrogate of our said County the last will & Testament of John Dodge deceased (a copy whereof is hereunto annexed) was proved and is now approved and allowed of by us, and the said deceased having whilst he lived and at the time of his death goods chattels or credits within this State by means whereof the proving & registering the said will and the granting administration of all and singular the said goods chattels and credits and also the auditing allowing & final discharging the account thereof doth belong unto us; The administration of all & singular the goods chattels and credits of the said deceased and any way concerning said will is granted unto Sarah Dodge and Daniel Dodge Executrix & Executor in the said will named they first being duly sworn each & faithfully to administer the same and to make & exhibit a true & perfect inventory of all and singular the said goods chattels and credits and also to render a just and true account thereof when thereunto required. In Testimony Whereof we have caused the Seal of Office of our said Surrogate to be hereunto affixed.
