John J. Phelps & William E. Dodge This Indenture made this second day of November A.D. 1867 Between John J. Phelps and William E. Dodge of the city and state To of New York of the first part and Patrick Houlihan of New Milford Patrick Houlihan Township, Susquehanna County and State of Pennsylvania of the Deed second part WITNESSETH, That the said parties of the first part in consideration of the sum of two hundred and fifty dollars by the party of the second part paid to the Delaware Lackawanna and Western Rail Road Company before the execution hereof, Do hereby grant, bargain sell assign transfer quit claim and convey unto the said party of the second part his heirs and assigns all their right title and interest in and to a piece of parcel or tract of land situate in the township of New Milford aforesaid bounded westerly by a line fifty feet Easterly from the track of the Delaware Lackawanna and Western Rail Road Company, Southerly and Easterly by the lands of said Houlihan, containing by estimate forty five acres more or less and being and being that portion of a tract of land known as the "Hayden Lot" lying on the Eastern side of and fifty feet from said Rail Road, the whole of which lot was purchased by William Hayden at Sherrif's Sale as the property of Benjamin Hayden - (See Deed Book in Susquehanna County No. 19, page 347 to % by said Hayden and others convey to George W. Scranton and by said Scranton's wife to said Phelps Dodge by Deed dated April 2 1855, recorded in said County in Deed Book No. 30, page 532. Excepting and reserving to and for the use of said Rail Road Company such additional width beyond the aforesaid fifty feet as may be required for a double track Rail Road, and neither the said parties of the first part nor said Rail Road Company shall ever be required to make or maintain a fence along the line between the lands hereby conveyed and the lands of said Rail Road Company To have and to hold the said lands with the heredicaments and appurtances as thereto belonging unto the said Patrick Houlihan his heirs and assigns forever. Dodge (Seal) County of New York Ss Be it remembered that on this 11th day of November Anno Domini one thousand eight hundred and sixty seven before me, William Walter Phelps, a commisioner of the State of Pennsylvania, duly appointed and qualified according to the laws thereof to take acknowledgments --. To be used and recorded therein personally approved the above named John J. Phelps and William E. Dodge who in due form of law, acknowledged the above Indenture personally to be their act and deed to the end that the same might be recorded as such, In testimony therof, I have hereunto set my hand and affixed my official seal.
